It comes down to interpretation. 42 U.S. Code 289g covers the prohibitions regarding human fetal tissue and states that, “It shall be unlawful for any person to knowingly acquire, receive, or otherwise transfer any human fetal tissue for valuable consideration if the transfer affects interstate commerce.” The valuable consideration is the sticking point. What's "valuable consideration"? How much over cost crosses over to "valuable consideration"? I'm not invested in this either way just enjoy the legal interpretation arguments.

... but if they were, wouldn't it still be illegal? She goes into the fact that it's not a "get rich quick" scheme or that they have positive motives but that doesn't negate the fact their actions might still violate the law as currently written. I am operating under the assumption that a prohibition against selling fetal tissue means that the organization is required to sell fetal tissue at cost, and that opponents are contending that Planned Parenthood is selling above cost and generating a profit.

Legally speaking. I don't think polygamy/group marriages would be that hard of a sell to the courts based upon the elimination of a requirement for a marriage to be between people of two different genders. With the redefinition of marriage, all that really remains is that it is between 2 people. There are sufficient religions and world cultures where polygamy is standard that a person (with sufficient financial backing ... because it'd be a tough fight) could probably challenge the "two people" requirement. I'm thinking you could come at from an "equal protection under the law" angle and a "freedom of religion" angle.
