Hmm...
Well from what I understand, a picture was posted of a girl in pink and white, and she was under 18, so I assume it was nude somehow...
Someone recognized the picture and told her mom or something.
So the guy who uploaded should be to blame.
But this raises a lot of questions:
How are you supposed to be able to tell a girls age?
What if the kid is 17 and so is the girl, and they want people their age to see it?

It's insane. Sometimes it really is impossible to know, so...err on the side of caution? One of the local high schools here had students sexting, called the police and they may prosecute for child pornography, even though the people who sent the pics were the subject of the pics.

I think if I were the lawyer for the sexting kids I would push for them to be tried as adults. Then I would argue that if they're being tried as adults, then they're not children, and it can't be child porn. Then I would collect fifty million dollars from each of them and move to Aruba.

A defence lawyer can't press for a client to be tried as an adult.
