As for the artwork that got removed, I thought it was very beautiful. They used only very few shades of colours, 5 or so, and only very few strokes, which is impressive. Too bad I won’t check any of their other art out since I JUST LOST INTEREST BECAUSE OF THIS UNACCEPTABLE BULLSHITTERY. FUCK.

Tiki wouldn’t “knowingly steal” your work. He always puts up a name and source when he knows them. And most people are fine with it, free advertisement and pulls in more people to your site. But he has always promptly removed anything that was unwittingly taken against the artist’s wishes.

Indeed, thanks for sticking up for sanity everyone. Sadly, it would appear that koukei is either not the author, or has no ability to link to examples of the image on a professional level, which is generally all the proof that I require for an image take down.
I will note that:
1.) I used to have a disclaimer on every page, but that was lost during the last site layout change. I’ll be digging it back up and re-adding it.
2.) Spamming the comments section of any website is a bad idea, and will lead to the ban hammer.
3.) koukei couldn’t / wouldn’t link to their portfolio. This is a beautiful image, and I do appreciate it’s composition, and would much rather have a link to the author’s site then not, but such information is not readily available to me. Links to the original content are always preferred, even if they’re only in the comments. About 9/10 of the images on MCS are uncredited, and the ones that ARE credited are usually done so by the Super Awesome MCS Members.
4.) Haven’t received a single e-mail about this. In fact, I wouldn’t have known anything was amiss had I not hit the site on my way into work.
5.) I think you’ll find that I have no problem with removing images, given proper notification, and verification. In fact, there’s a whole category on MCS that deals with the posts that have been removed in the past.
6.) I think you’re a troll. You might have authored the image, but you’re still a troll.

Legal action can only be taken if you prove a revenue stream or prove that he interfered with your own. The idea that this information is going to help you however is ludicrous, as every board using the *chan interface is a giant clearing house for images with literally thousands of them being posted and deleted every hour. Putting a © on your site doesnt prove that you own those images. You need to go through the proper steps to ensure that you actually do own the copyrights to said images, which i doubt you have actually done. And even if you HAVE done that, your copyrights accorind to YOUR own site, expired Jan 1st, 2007.
So unless you can prove that you actually own the copy rights to the image in question (A © on a website isn’t sufficient proof.). There is no legal way to force Tiki to remove the image.
The easiest way to ensure you own the copyrights to something, is to mail a copy of it to yourself. that way it gets an offical government seal verifying the date that it was mailed, and after your letter gets sent back to you with the disk, or orginal print of the image, you can safely distribute it without worry of copyright infringement, and if you ever needed to take someone to cvourt that envelope with the government stamp would be proof of when you orginally created the document. But i doubt you have that unopened letter from yourself soooo Shut the fuck up and stop whining, you should be happy that there are more people appreciating your “art”.
And considering MCS is getting on average over 100K hits a day and your site doesn’t even get enough hits to show up on any site comparison tool i can find you should be THANKING tiki, not insulting him.

Kero is right. Saying “Copyright” does not mean it is legally copyrighted. The mailing thing works, and I know there’s also the Library of Congress (at least for writing, I am not sure how that works for photography).
You can’t slap a © on something and say it’s copyrighted.
Granted, you’re only “required” to provide such evidence in a trial, but since you threatened legal action, you may as well be prepared.

Under the Berne copyright convention, a work is automatically copyrighted at the time of creation. Registering your copyright helps your case if you take legal action, but its not necessary.
Mailing it to yourself creates a legal verifiable date of creation, but does not copyright the work. (IANAL).

He would have no proof that I am, in fact, the artist simply because I signed on with the username and linked to the original site. I could sign on with the username Luis Royo, link to Royo’s page and demand that any Royo images be removed. That in no way proves that I am Royo and the images are mine.

Putting a © on your site doesnt prove that you own those images. You need to go through the proper steps to ensure that you actually do own the copyrights to said images, which i doubt you have actually done. And even if you HAVE done that, your copyrights accorind to YOUR own site, expired Jan 1st, 2007.So unless you can prove that you actually own the copy rights to the image in question (A © on a website isn’t sufficient proof.). There is no legal way to force Tiki to remove the image.
The easiest way to ensure you own the copyrights to something, is to mail a copy of it to yourself. that way it gets an offical government seal verifying the date that it was mailed, and after your letter gets sent back to you with the disk, or orginal print of the image, you can safely distribute it without worry of copyright infringement, and if you ever needed to take someone to cvourt that envelope with the government stamp would be proof of when you orginally created the document. But i doubt you have that unopened letter from yourself soooo Shut the fuck up and stop whining, you should be happy that there are more people appreciating your “art”.
And considering MCS is getting on average over 100K hits a day and your site doesn’t even get enough hits to show up on any site comparison tool i can find you should be THANKING tiki, not insulting him.

Kero is right. Saying “Copyright” does not mean it is legally copyrighted. The mailing thing works, and I know there’s also the Library of Congress (at least for writing, I am not sure how that works for photography).
You can’t slap a © on something and say it’s copyrighted.
Granted, you’re only “required” to provide such evidence in a trial, but since you threatened legal action, you may as well be prepared.

The thing i find funniest about this is that had you e-mailed Tiki, and simply asked him to remove the image, he would have done so no problem. It’s happened before. But since you were such a douche about it I doubt that will happen now. Unless of course you can come up with solid proof that you own the image, which as I already stated is impossible for you to do at this point.

Under the Berne copyright convention, a work is automatically copyrighted at the time of creation. Registering your copyright helps your case if you take legal action, but its not necessary.
Mailing it to yourself creates a legal verifiable date of creation, but does not copyright the work. (IANAL).
Still, koukei should quit complaining in the comments sections and contact tiki directly.

Yeah this has been the week from hell on top of the month from hell. The software company we support was late to put out a time sensitive update at the last moment. It is required by all our user base to use the first of next month. Well the company fucked it up. It is blowing customers shit up left and right. The phones have been flooded with angry people. We have no fix, and no eta on a resolution. All we can do is go through the motions and blow smoke up the users asses till they figure out what exactly they fucked up and then find a way to fix it. So we have been working major overtime getting screamed at over and over by the users.
The past two weekend our boss (a.k.a. The Uber-bitch) used the natural disaster emergency contacts list to send everyone text messages asking if we were coming in for the weekend. Well apparently not enough people did so Sunday night at about 9 we get a mass text message that stated EVERYONE had to show up at 8 am Monday, regardless of shift and work until they said we could leave. Even those of use scheduled to work the second shift. So thus far I have worked over 25 hours in two days without and end in sight. They ordered us all in at 8 am today and again tomorrow and every day further until the owner feels we are allowed to resume our normal schedules.
This is after removing the good boss we had in favor of the Uber-Bitch, who is a brown-nosing back-stabbing iron clad twat. We have been restricted from ALL internet surfing, we are no longer allowed to listen to music on our PC’s, we have had our systems encrypted, they took away two of our whopping 6 holidays (The day after Xmas and the day after New years) since they are on the weekend, and we are having to BEG to get time off approved even when we have the PTO to use. When anyone complains we are pointedly told to be thankful we have jobs.

I work at a go kart track. Which is pretty bitchin, it’s minimum wage but I get paid to sit in the shade and occasionally run out and right karts that crash. But I’m going home on the 23rd, and I was all “I’ll tell my boss I’m leaving on Tuesday,that’ll give him a week to replace me, and then my paycheck on Saturday will be enough to pay off the cash I owe for rent”, but then he texted me on Sunday night being like “You’re not working Monday or Tuesday”, and I’m not scheduled for Wednesday anyway, so I’m going to have to cycle over there tomorrow night around closing and A) tell him I’m leaving in 6 days and B) ask for more days to replace the days I lost so I can pay off my debts, but if he gives me days it’ll mean I’m working solid up until I leave, and there’s at least one big party between now and then, and I’m going to Niagara tomorrow for the days, and my perfect plan has just fallen apart.
There’s not really much adspace left on MCS, what sort of hits do your other sites get? MCS+ as it stands I don’t think would draw in anyone who wasn’t already part of the community, and our community’s pretty small, so I don’t know how much income that nets you but I doubt it’s a solid chunk of change.
Maybe if you had some sort of gimmick, like failblog has failure, then you’d draw in more folks and subsequently more cash?
