Don’t listen to Wisebrute. Before you take ‘leagle action’, listen very carefully: If Tikigod accidentally uses a copyrighted image the person doesn’t want used freely, you only have to ask him. Either by E-mail, by a simple polite post here, or contact him on his many IM services.
He always has taken images down by request, and always will. He has never made an exception. However, having a spam attack is no way to go about this. It’s 4AM where he lives, HE IS ASLEEP. Just wait it out a bit.

Tiki wouldn’t “knowingly steal” your work. He always puts up a name and source when he knows them. And most people are fine with it, free advertisement and pulls in more people to your site. But he has always promptly removed anything that was unwittingly taken against the artist’s wishes.

If anything, it could give your work more publicity. I would be grateful if my work was posted on here. With the correct credit, of course. The easy way to get that is to put a watermark or website address at the bottom.

Indeed, thanks for sticking up for sanity everyone. Sadly, it would appear that koukei is either not the author, or has no ability to link to examples of the image on a professional level, which is generally all the proof that I require for an image take down.
I will note that:
1.) I used to have a disclaimer on every page, but that was lost during the last site layout change. I’ll be digging it back up and re-adding it.
2.) Spamming the comments section of any website is a bad idea, and will lead to the ban hammer.
3.) koukei couldn’t / wouldn’t link to their portfolio. This is a beautiful image, and I do appreciate it’s composition, and would much rather have a link to the author’s site then not, but such information is not readily available to me. Links to the original content are always preferred, even if they’re only in the comments. About 9/10 of the images on MCS are uncredited, and the ones that ARE credited are usually done so by the Super Awesome MCS Members.
4.) Haven’t received a single e-mail about this. In fact, I wouldn’t have known anything was amiss had I not hit the site on my way into work.
5.) I think you’ll find that I have no problem with removing images, given proper notification, and verification. In fact, there’s a whole category on MCS that deals with the posts that have been removed in the past.
6.) I think you’re a troll. You might have authored the image, but you’re still a troll.

I’m confused. If you’re a photographer who considers yourself an artist and you want the picture removed that’s fine. Legal action can only be taken if you prove a revenue stream or prove that he interfered with your own. Otherwise regular IP law and how it applies to the internet is so foggy you’d be better off suing tiki for stealing your ability to spell.
Outside of the .00002 cents the ads generated for the one post made I don’t see a profit.

Putting a © on your site doesnt prove that you own those images. You need to go through the proper steps to ensure that you actually do own the copyrights to said images, which i doubt you have actually done. And even if you HAVE done that, your copyrights accorind to YOUR own site, expired Jan 1st, 2007.
So unless you can prove that you actually own the copy rights to the image in question (A © on a website isn’t sufficient proof.). There is no legal way to force Tiki to remove the image.
The easiest way to ensure you own the copyrights to something, is to mail a copy of it to yourself. that way it gets an offical government seal verifying the date that it was mailed, and after your letter gets sent back to you with the disk, or orginal print of the image, you can safely distribute it without worry of copyright infringement, and if you ever needed to take someone to cvourt that envelope with the government stamp would be proof of when you orginally created the document. But i doubt you have that unopened letter from yourself soooo Shut the fuck up and stop whining, you should be happy that there are more people appreciating your “art”.
And considering MCS is getting on average over 100K hits a day and your site doesn’t even get enough hits to show up on any site comparison tool i can find you should be THANKING tiki, not insulting him.

Kero is right. Saying “Copyright” does not mean it is legally copyrighted. The mailing thing works, and I know there’s also the Library of Congress (at least for writing, I am not sure how that works for photography).
You can’t slap a © on something and say it’s copyrighted.
Granted, you’re only “required” to provide such evidence in a trial, but since you threatened legal action, you may as well be prepared.

Under the Berne copyright convention, a work is automatically copyrighted at the time of creation. Registering your copyright helps your case if you take legal action, but its not necessary.
Mailing it to yourself creates a legal verifiable date of creation, but does not copyright the work. (IANAL).
Still, koukei should quit complaining in the comments sections and contact tiki directly.
